ARTICLE 1: Purpose

The purpose of these general terms of use is to provide legal framework for the use of the Enseignement Abénaki website (https://enseignementabenaki.com) hosted by Wix.com and its services.

This contract is concluded between:
• Réjean OBomsawin and Jacinthe Laliberté, responsible for the website, hereinafter called "the Publisher",
• Any natural or legal person aged 18 years and over wishing to access the site and its services, hereinafter referred to as "the User".
The general conditions of use must be accepted by any User, and his access to the site is deemed to be acceptance of these conditions.

The site Enseignement Abénaki is edited by Réjean OBomsawin and Jacinthe Laliberté, domiciled in Odanak, Quebec, Canada.

The User of the Enseignement Abénaki site has free access to the following services:

• Nikwôbi Newsletter - monthly newsletter;

• Create a site member account;

• Access to the press room.​

The following services are only accessible to the User if he is duly registered, that is to say, if he is identified by means of his validated registration:

• Full programming;

• Upcoming events in virtual and face-to-face;

• Special and past events;

• Online gift shop;

• Indigenous bookstore;

​

• Access to make a donation;

• Access to the company pages;

• Indigenous space - blog (with VIP membership).

​The site and its various services may be interrupted or suspended by the Publisher, in particular during maintenance, without prior notice or justification.

ARTICLE 4 : User’s responsibility

The User assumes full responsibility for the use he makes of the information and contents present on the site Enseignement Abénaki.

The site allows users to send:
• Comments
• Questions.
The User undertakes to make statements that respect all and the law and accepts that these publications are moderated or refused by the Publisher, without obligation of justification.

ARTICLE 5 : Publisher’s responsibility

Any malfunction of the server or network cannot engage the responsibility of the Publisher.
Likewise, the site cannot be held liable in case of force majeure or the unforeseeable and insurmountable fact of a third party.

The contents of the Abénaki Teaching site and social network pages that are animated by the Publisher (logos, texts, graphic elements, videos, photos, audios, content, URL, etc.) are protected by copyright under the Intellectual Property Code of Canada.

The User must obtain the permission of the Publisher of the site before any reproduction, copy or publication of these different contents and must specify the source if necessary.
These contents, authorized in advance by the Publisher, may be used by the requesting Users for private purposes only; any commercial use is prohibited.

The User is fully responsible for any content that he may post online and he undertakes not to harm a third party.

The Website Editor reserves the right to freely and at any time moderate or remove content posted by Users, without justification.

The User may make constructive and respectful comments on the Publisher’s website and social media pages.

The Publisher reserves the right to hide or delete a comment at its discretion and without notice to the User, if we are of the opinion that it contains or constitutes:

• An attack or a breach of privacy or reputation;
• information that is offensive, disrespectful, defamatory, obscene, abusive, threatening, racist, sexist, aggressive, abusive or hurtful;
• Incomprehensible or irrelevant information
• Spam, comments or information sent repeatedly;

• information that may be interpreted;

• unsolicited advertising, promotion or solicitation;

• personal information or confidential information;

• information that refers to or encourages the practice of illegal activities or that contravenes any law, regulation or government order, or promotes information that is false, misleading or illegal or illegal conduct, or incites violence; or

• any other information that we deem to be unacceptable in the context in which it is published.

 

The User concerned may also see his publications limited, his account deleted, banned from this page and his privileges of the site removed without justification.

The User must provide personal information to register for the services offered on the site.

We encourage the use of third party provider(s) services to enable our users to conduct online transactions. Any purchase made through the website of a provider or bank is governed by the terms and conditions specific to this website.

In the event that a transaction is made by cheque or postal order, the information will not be retained by Enseignement Abénaki, but transmitted directly to the providers or financial institutions mandated for processing transactions.

ARTICLE 8 : Hyperlinks

The domains to which links on the site lead do not engage the responsibility of the Enseignement Abénaki Editor who has no control over these links.

It is possible for a third party to create a link to a page of the Enseignement Abénaki website WITH the express permission of the Publisher.

ARTICLE 9 : Changes to the general conditions of use

The Abénaki Education site reserves the right to change the terms of these general conditions of use at any time and without justification.

It gives itself the right to change access to its website at any time. Changes will be effective automatically upon posting on this page or elsewhere on the website.

ARTICLE 10 : Contract term

The duration of this contract is indefinite. The contract takes effect in respect of the User from the beginning of the use of the site Enseignement Abénaki.

ARTICLE 11 : Applicable law and competent jurisdiction

This contract is subject to the laws of Quebec and Canada. The content of the Enseignement Abénaki website is made available to you from the office in Odanak, Quebec (Canada), only on condition that you accept the conditions below.

If you do not agree to these terms, you are NOT allowed to consult this site or receive our mailings, or use our services and it is against our will that you obtain a copy of our documents.

OBLIGATORY CONDITIONS

 

To use the Abénaki Teaching site and receive our mailings:
• No matter where the pages you access are physically located, the original of the Site is in our offices in Odanak and everything that happens on or off our Site shall be deemed to be taking place in Odanak, in our offices;
• Regardless of where you access our site, you must consider that the laws applicable in Quebec and Canada govern what happens on our site and with us, as if you were physically coming to our Odanak office;
• If the laws of your country or region prohibit anything happening on our site or on the margins of our site, you are responsible for respecting them and refrain from using this site.
